Liability In San Diego Hit-And-Run Car Accidents
Thousands of people are seriously injured every year in hit-and-run collisions. According to AAA, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” There are a number of factors that could potentially contribute to a hit-and-run collision.
- Speeding
- Distracted driving
- Inclement weather
- Driver fatigue
Every driver has a legal obligation to exercise due care to avoid collisions. A large number of collisions are due to drivers that make dangerous left turns. Drivers are supposed to yield the right-of-way to vehicles and bicyclists traveling from the opposite direction that are close enough so as to pose a hazard. If a driver flees the scene of a collision, they could face civil and criminal liability for their actions. There are a number of steps that should be taken in order to help track down hit-and-run drivers.
- Surveillance footage should be sought.
- Eye witnesses should be interviewed.
- Fragments of the fleeing vehicle should be examined.
Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. However, in order to win any civil claim, plaintiffs will need to demonstrate negligence. A personal injury attorney can examine the unique facts of your case and let you know what your legal options are.
