Liability In San Diego County Inmate Death

San Diego County has a long and sordid reputation for being one of the worst places for inmates to be sentenced. According to one study mentioned in the San Diego Tribune, San Diego County has the highest number of “excess deaths” among California’s 12 largest jail systems. There are a number of factors that can lead to in custody deaths.

  • Jails may not be adequately staffed.
  • Correctional officers may not be adequately trained.
  • Inmates may not be properly monitored.

Inmates have a constitutional right to receive reasonably adequate healthcare. Failure to give inmates adequate care is a deprivation of their constitutional rights. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. For example, a jail may have failed to give inmates adequate care in the middle of a medical emergency. There are a number of steps that should be taken after any inmate death.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • An autopsy may need to be performed.

The family of any inmate that died in custody may have legal recourse through a wrongful death claim. Damages in a civil claim can help with many of the unexpected expenses that come with the sudden loss of a loved one. However, jails are almost never transparent about how an inmate died. This is why it is so important that all evidence is preserved after an in custody death.
