Liability In Washington Semi-Truck Accidents

Thousands of people are killed or seriously injured in semi-truck accidents every year. According to the IIHS, “There were 35,766 fatal motor vehicle crashes in the United States in 2020 in which 38,824 deaths occurred. This resulted in 11.7 deaths per 100,000 people and 1.34 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.9 in Massachusetts to 25.4 in Mississippi.”  There are a number of factors that could potentially contribute to a semi-truck accident.

All truck drivers must exercise due care in order to avoid causing accidents. This includes driving at a safe speed. Drivers will typically need to slow down in construction zones as indicated by traffic control devices.  Pursuant to Washington Revised Code RCW 46.61.145, no driver shall follow another vehicle more closely than what would be reasonable or safe given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane. Victims of semi-truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Organ damage
  • Spinal cord injuries
  • Lacerations

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage.
