Liability In San Francisco Pedestrian Accidents
Some sections of San Francisco can be particularly dangerous for pedestrians. According to the San Francisco Chronicle, “Since 2011, S.F. General has treated 5,337 patients for severe traffic injuries […], according to a new report by the city’s Department of Public Health examining traffic injury trends over the past decade.” Most of the accidents that occur happen on a select number of streets. There are a number of factors that can contribute to a pedestrian accident.
- Pedal confusion
- Inclement weather
- Driver distraction
- Speeding
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall yield the right of way to a pedestrian crossing in a lawfully marked crosswalk. Even if a pedestrian is outside of a lawfully marked crosswalk, drivers must scan the road ahead of them and reduce their speed to avoid hitting pedestrians. If a driver fails to reduce their speed to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken bones
- Spinal cord injuries
- Lacerations
- Organ damage
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win any civil claim plaintiffs will have to demonstrate negligence. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
