Liability In Berkeley Pedestrian Accidents

Despite numerous efforts to improve pedestrian safety, the number of fatal pedestrian collisions in Berkeley is on the rise. According to Berkeleyside, “Berkeley had significantly more fatal crashes and collisions causing injuries in 2021 than in the prior year, according to new traffic data released by police in February. There were also 433 collisions last year that resulted in injuries, a 37% increase over injury crashes in 2020, BPD said.” There are a number of factors that could potentially contribute to a pedestrian collision.

  • Poorly illuminated roadways
  • Drunk driving
  • Inclement weather
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians.  Pursuant to California Vehicle code 21950, the driver of any vehicle must yield the right of way to any pedestrian that is crossing the roadway in a lawfully marked crosswalk. If a driver goes past a yield sign without yielding this may be considered prima facie evidence of their failure to yield. There are a number of steps that should be taken after any pedestrian collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The intersection where the accident took place should be examined.
  • A pedestrian accident attorney should be consulted.

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages can help cover many of the unexpected expenses that come with a serious injury. This includes the lost wages that a person may incur as a result of a collision. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
