Liability In Berkeley Pedestrian Accidents

Thousands of people are killed or seriously injured every year in pedestrian accidents. According to the CDC, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” The vast majority of pedestrian collisions are avoidable and due to some amount of human error.

  • Nearly a third of fatal pedestrian collisions involve an intoxicated driver.
  • Pedestrian collisions are more likely to occur at night when visibility is reduced.
  • Many pedestrian collisions are due to drivers that are distracted.

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than what would be safe or reasonable given the prevailing  conditions of the road. If a driver fails to yield the right of way to a pedestrian crossing in a lawfully marked crosswalk, they can be held at fault through a civil claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including.

  • Broken bones
  • Spinal cord injuries
  • Head injuries
  • Lacerations

Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often fight hard to deny any responsibility for a car accident. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
