Liability In Lucas Valley DUI Car Accidents
Driver intoxication is one of the leading causes of fatal collisions in the United States. According to the NHTSA, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 45 minutes. In 2020, 11,654 people died in alcohol-impaired driving traffic deaths — a 14% increase from 2019. These deaths were all preventable.” Drivers often drive drunk dozens of times before they are eventually caught and arrested. Even small amounts of alcohol below the legal limit can impair drivers in the following ways.
- Small amounts of alcohol can make it hard for drivers to stay in their own lane.
- Small amounts of alcohol will often delay a driver’s reaction times.
- Small amounts of alcohol will make it hard for drivers to stay alert.
It is illegal for any driver to operate a motor vehicle under the influence of alcohol or drugs. Pursuant to California Vehicle Code 23152, no person shall operate a motor vehicle with a blood alcohol content (BAC) of 0.08% or higher. The driver of a commercial vehicle shall not drive with a bac of 0.04% or higher. If a driver hits a pedestrian while under the influence of drugs or alcohol, they can be held at fault through a civil claim.
Depending on the facts of any case, liability for a car accident could extend beyond an at fault driver. For example, a person or company that loaned their vehicle to someone who was visibly intoxicated could be held at fault for an accident under the doctrine of negligent entrustment. There are a number of steps that should be taken after any car accident involving a drunk driver.
- Photos of the accident site should be taken.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- A thorough, independent investigation should be conducted.
A drunk driver could be held accountable for an accident through a criminal claim. The victim’s family can also hold a drunk driver accountable through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
