Liability In Jolon Head-On Collisions

Head-on collisions are among the most dangerous types of collisions that a person can be involved in. They account for only around 2% of all collisions but over 10% of all traffic fatalities. Two cars hitting each other head-on at 50 mph is like one vehicle hitting a brick wall at 100 mph. There are a number of factors that could potentially contribute to a head-on collision.

  • Head-on collisions are more likely to occur when drivers are distracted
  • Head-on collisions are more likely to occur during periods of inclement weather.
  • Head-on collisions are more likely to occur at night or when there is reduced visibility.
  • Head-on collisions are more likely to occur when there are poor road conditions.

The vast majority of head-on collisions are totally preventable. They often occur when drivers cross over double yellow lines and into opposing traffic. Pursuant to California Vehicle Code 21460, no person shall drive over a pair of double yellow lines unless such action is permitted by the statute. If a driver crossed over double yellow lines, they will typically be held at fault in the event of a collision. There are a number of steps that should be taken after any head-on collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help with medical bills, lost wages and pain and suffering. It is extremely important that evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
