Liability In Kings County Truck Accidents

Thousands of people are killed or seriously injured in truck accidents every year. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” Truck drivers are often asked to fulfill unrealistic delivery expectations which can also contribute to accidents. There are many steps that truck drivers should take in order to prevent accidents.

  • Truck drivers should be well rested before the start of their shift.
  • Truck drivers should plan their routes ahead of time.
  • Truck drivers should check their blind spots before making turns.

Truck drivers must exercise due care in order to avoid hitting other drivers. Pursuant to California Vehicle Code 22350, no person shall drive a vehicle faster than what would be safe given the prevailing conditions of the roadway. Drivers must also reduce the speed of their vehicle in order to avoid a collision. When a truck driver fails to reduce their speed to avoid a collision, they could be held at fault through a civil claim. Their employer could potentially also be held at fault. Victims of semi-truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Determining liability in a truck accident can be very difficult. It’s important that evidence is properly gathered and analyzed. The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Sadly, though, truck companies will often fight hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
