Teacher Accused of Sexual Abuse At Eastvale’s Eleanor Roosevelt High School

EASTVALE, CALIFORNIA (April 14, 2022) – A 30-year-old teacher at Eastvale’s Eleanor Roosevelt High School has been arrested on multiple charges of lewd and lascivious acts with one of her students.

Riverside County police officials are saying that the teacher also worked as a water polo and swim coach at the school. She was arrested at Eleanor Roosevelt High School and has since been released after posting $50,000 bail.

The arrest comes after allegations that the 30-year-old teacher had an inappropriate relationship with a minor student. She is also accused of sending sexually explicit photos to that student.

A full investigation into the incident at Eastvale’s Eleanor Roosevelt High School remains ongoing at this time.

Liability For Teacher / Student Sexual Abuse In Eastvale

Sexual abuse by teachers is far more common than many people realize. According to data from the U.S. Department of Education, roughly 10% of students experience sexual misconduct by a teacher at some point during their K-12 school experience. The typical offender does not fit the profile that many people would imagine. Failure to report inappropriate sexual conduct at a school is a crime that can be punished with jail time pursuant to California Penal Code 11166(c). In addition to criminal sanctions, a school district could also face civil liability if a student in their care is sexually abused by a teacher. As outlined in California Government Code section 815.2, a public entity such as a school district can be liable for an act or omission of their employee when that employee is working within the course and scope of their job duties.

The sexual abuse of students in most situations is preventable and due to a lack of adequate supervision of the offending party. Consider, for example,  Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” According to Virginia G. v. ABC Unified School District (1993) 15 Cal.App.4th 1848, a school could be liable for a child being sexually assaulted by a teacher if supervisors knew (or should have known) about the offending teacher’s history of sexual misconduct. There are a number of signs that parents should look for which might suggest their child is being sexually abused at school.

  • Students who are victims of sexual abuse might have a sharp decline in academic performance.
  • Students who are victims of sexual abuse may experience a sudden loss of appetite which is out of the ordinary.
  • Students who are victims of sexual abuse may recoil from being touched or hugged.
  • Students who are victims of sexual abuse may have sudden changes to their mood or demeanor.

The family of any student that is sexually abused by a teacher at school may be able to seek some measure of justice through a civil claim. Damages in a civil claim can include medical costs, cost for psychological care and counseling and punitive awards. The sexual abuse of students is no small matter and can adversely effect a child’s emotional and psychological well-being for decades. Victims of sexual abuse are more prone to suicide, eating disorders and chronic illness.
