Liability In Red Rock Drowning Accidents

Drowning is a leading cause of death among children ages 1 -4. But anyone at any age is potentially at risk of drowning. This is especially true for people who may have underlying medical conditions. According to the Centers for Disease Control,  “People with seizure disorders such as epilepsy are at a higher risk of fatal and nonfatal drowning than the general population. Drowning is the most common cause of unintentional injury death, with the bathtub being the most common site of drowning for people with seizure disorders.” There are many other factors that can make drowning more likely.

  • Not being able to swim.
  • Missing or ineffective fences around pools.
  • A lack of close supervision.
  • The use of prescription medications.

Depending on the facts of any case, there could be numerous liable parties for any drowning accident. Businesses have a legal responsibility to maintain their premises in a reasonably safe condition. Pursuant to California Civil Code 1714, a property owner could be liable for an accident caused by his or her lack of ordinary care in the maintenance of his or her property. When a property owner is aware of a dangerous condition on their property, they must take measures to correct the dangerous condition.

There are many ways that a pool area could be in a dangerous condition so as to create a potential hazard. For example, lifeguards may be distracted by their cellphones instead of paying attention to the water. Uncleaned pools with murky water could make it more difficult to see guests that are struggling. A pool may also lack warning signs letting guests know that the water is shallow or that they must swim at their own risk. There are a number of steps that businesses can take in order to prevent drowning accidents.

  • All lifeguards should be properly trained. This includes having an understanding of CPR.
  • Certain pools should have fences or gate guards to regulate the flow of guests coming in and out.
  • The pool should be properly maintained and regularly cleaned.
  • The pool should never exceed capacity.

The family of any victim that died in a drowning accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and loss of love. Potential beneficiaries in a civil claim will typically include a victim’s next of kin such as their spouse or dependent children. Sadly, though, businesses will fight to deny any responsibility if someone drowns on their property. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
