Liability In Mountain View Truck Accidents

Nearly 2% of all traffic fatalities every year involve bicyclists. According to the Insurance Institute for Highway Safety (IIHS), “Although bicyclist deaths have decreased 16 percent since 1975, they have increased 36 percent since reaching their lowest point in 2010. Most bicyclist deaths in 2019 (90 percent) were those ages 20 and older.” Helmets are incredibly important and can reduce fatal bicycle accidents by as much as 50%. There are many different factors that could potentially contribute to a bicycle accident.

  • Accidents are more likely to occur when drivers are speeding.
  • Many collisions involve drivers that are distracted by their phones.
  • Poorly illuminated intersections are also a big problem.
  • Sadly, many fatal bicycle accidents involve intoxicated drivers.
  • Drowsy driving can be just as dangerous as drunk driving.

Truck drivers are held to a high standard in terms of safety and must get a commercial license. There are numerous rules and regulations that truck drivers must abide by. For example, truck drivers cannot be on duty for more than 14 hours and cannot drive more than 11 of those hours. They are also held to a higher standard in terms of what is considered “intoxicated.” A truck driver must not operate their vehicle with a BAC of 0.04% or higher, as compared to 0.08% for other drivers.

All truck drivers are expected to use caution when around pedestrians and bicyclists. They could be liable if they hit someone. According to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed than would be reasonable or safe given the prevailing conditions of the roadway. Additional speed constrains will apply if a person is traveling through a school zone during certain periods.

Depending on the facts of any case, liability for a collision could extend beyond a truck driver. The company that owned a truck could potentially face liability if their driver hits someone. They could also be liable if they failed to properly vet a driver that did not have the right license or qualifications to work. It is important to understand the relationship between a truck driver and the entity paying their salary. There are many steps that should be taken after any truck accident.

  • Surveillance footage should be sought.
  • All drivers involved should be interviewed and, potentially, tested for illegal substances.
  • Eye witnesses should be interviewed.
  • The history of collisions at any intersection should be examined.

The family of any victim that died in a truck accident may have legal recourse through a wrongful death claim. Damages can help with many of the expenses that can come with the sudden and tragic loss of a loved one. In certain circumstances, family members may also be able to pursue a survival action claim if the victim survive for some period prior to their death. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
